Terms and Conditions

These Terms and Conditions (“Terms”) apply to beatupthesun.com and to the programs, classes, events, and products offered by The Perspective Project, LLC, doing business as Beat Up the Sun (“Beat Up the Sun,” “we,” “us”). By using our website, signing up for a program, or buying a ticket or product, you agree to these Terms. If you don’t agree, please don’t use our services.

1. Who we are

2. Eligibility

Our services are for adults 18 and older. Minors may participate only with the permission and supervision of a parent or guardian, who accepts these Terms on their behalf.

3. Health and assumption of risk

Yoga, movement, breathwork, and meditation are physical activities that carry a risk of injury. Our content is for general wellness and education only. It is not medical advice and is not a substitute for care from a qualified health professional.

  • Talk with your doctor before starting any exercise program, especially if you are pregnant, recovering from an injury or surgery, or have any medical condition.

  • Listen to your body, skip anything that doesn’t feel right, and stop if you feel pain, dizziness, or discomfort.

  • You participate voluntarily and at your own risk.

  • To the fullest extent allowed by law, you release The Perspective Project, LLC, Beat Up the Sun, Rick Shugarman, and our instructors and contractors from liability for any injury, loss, or damage related to your participation.

4. Live online classes

  • Tickets are sold through Eventbrite and are subject to Eventbrite’s terms as well as these Terms.

  • Access: the class link is provided to ticket holders through Eventbrite. Please don’t share it. Each ticket admits one person.

  • Refunds: refund terms are listed on each event page. Unless the event page says otherwise, you can get a full refund up to 24 hours before class. After that, tickets are non-refundable, but the class replay is still included.

  • Replays: when a replay is offered, it is available to ticket holders for the time stated on the event page (for example, 7 days), and then removed.

  • Recording: classes may be recorded. Replays show only the instructor. Attendee cameras are optional. If you turn your camera on, the instructor and any co-host may see you, but other attendees will not.

  • Changes and cancellations: if we need to reschedule or cancel a class, we’ll notify ticket holders and offer a ticket for the new date or a full refund.

  • Conduct: please be respectful in chat and during class. We may remove anyone who disrupts a class, without a refund.

  • Technical issues: you are responsible for your own internet connection and device. If a problem on our end prevents a class from happening, we’ll offer a replay, a new date, or a refund.

5. Free programs and emails

When you sign up for a free program, you agree to receive the program and occasional emails from us, including updates and offers. You can unsubscribe at any time using the link in any email.

6. Purchases

Prices, availability, and descriptions of products and services may change. Payments are handled by our payment processors and ticketing partners. Any additional purchase terms (for example, for retreats, courses, memberships, or physical products) will be shown at checkout and apply along with these Terms.

7. Intellectual property

All content we provide, including videos, replays, class content, PDFs, music, writing, images, and our name and logo, belongs to The Perspective Project, LLC or its licensors. It is for your personal, non-commercial use only. Please don’t copy, record, share, resell, or redistribute it without our written permission.

8. Testimonials and submissions

If you send us feedback, testimonials, or other content, you give us permission to use it to improve and promote our services. We’ll ask before using your name or image.

9. Third-party services and links

We use third-party services such as Eventbrite, Zoom, YouTube, Wix, and Meta, and our site may link to other websites. We aren’t responsible for third-party services or sites, and your use of them is subject to their own terms.

10. Disclaimers

Our services are provided “as is.” We don’t promise any particular result from our programs, and individual results vary.

11. Limitation of liability

To the fullest extent allowed by law, The Perspective Project, LLC and its owners, instructors, and contractors will not be liable for indirect, incidental, or consequential damages. Our total liability for any claim related to our services is limited to the amount you paid us for the service in question.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Any dispute will be handled in the state or federal courts located in Los Angeles County, California.

13. Changes to these Terms

We may update these Terms from time to time. The effective date at the top shows when they last changed. Continuing to use our services after an update means you accept the new Terms.
